Terms of Use
Introduction
This document describes the EUDAT CDI B2SHARE service's terms of use and responsibilities of service users and contractual parties. This document is part of the EUDAT CDI B2SHARE Service Description.
Responsibilities and Rights of the Service Users
- Service Users must adhere to the EUDAT CDI Acceptable Use Policy and Conditions of Use (AUP).
- Service User must adhere to the EUDAT Services Terms of Use.
- Service Users must agree and comply with the responsibilities described in the General Terms of Use for CSC's Services for Research.
- User is responsible for ensuring that the content processed in the Service are used with rights that entitle the User to process the content in question in the manner intended in the Service.
- AUP: You shall respect intellectual property and confidentiality agreements.
- User is responsible for ensuring that the necessary descriptive information is attached to the data stored in the Service. The required descriptive information is specified as mandatory information in the Datacite DOI metadata model.
- Each User who publishes a record in B2SHARE acts as the controller of the data they store and publish in the Service. The processing of personal data is subject to the terms and conditions for the processing of personal data as described in the EUDAT CDI B2SHARE Privacy Notice
- In case of problems and to ensure the protection of their rights, users can request assistance from the EUDAT Help Desk: https://eudat.eu/contact-support-request
- Users should report issues caused by the user or about issues with a service, service component or resource provided by EUDAT partners in a reasonable timeframe, if the issue is related to a violation of these terms.
- Reports about violations should be directed to the EUDAT Helpdesk, which will document and redirect the issue report to the appropriate site and person(s) for action or will handle it directly, depending on where the violation has occurred.
- AUP: You shall promptly report known or suspected security breaches, credential compromise, or misuse to the security contact stated below; and report any compromised credentials to the relevant issuing authorities.
- Users authorize the Service Provider to copy the descriptive information of the datasets selected for open publication in the Service to EUDAT B2FIND. Copied metadata can be further harvested to other similar research information services.
Responsibilities and Rights of User Communities
Each B2SHARE user Community has additional responsibilities as detailed in the B2SHARE Community Agreement. Community Administrators agree to these Terms upon creating a community and the assignment of the community Administrator role.
Responsibilities and Rights of the Service Provider
- Service Provider may at any time limit, suspend or terminate access to the Service, including removal of User Content within the service, without notice
- In the event of any unauthorised use of the Service
- If the Service Provider has a legitimate reason to believe that the Service is being used in violation of these Terms or the Service Descriptions.
- Service Provider reserves the right to inspect User Account information and User Content for purposes of incident management, error correction and in case of suspicion of illegal or otherwise inappropriate use of the Service.
- Service Provider has the right to contact User's home organisation or Community Administrator, or other party granting access to the Service, regarding actions needed for correcting illegal, outdated or otherwise inappropriate data or metadata.
- Service Provider maintains up-to-date documentation.
- B2SHARE's up-to-date service documentation is available at https://docs.eudat.eu/b2share/overview/
- Service Provider can make updates and clarifications to service documentation or other instructions on their web pages.
- Service Provider notifies of significant changes on the service website.
- Service Provider does not guarantee the accuracy of the documentation, and the Customer uses it at their own risk.
- Service documentation will be provided in English.
- Service Provider is responsible for ensuring that the service support address is visible to end users of the Service as part of the user interface.
- The use of the B2ACCESS component can be necessary for the functioning of the Service. Documentation of B2ACCESS can be found at: https://docs.eudat.eu
Changes to these Terms
Service Provider reserves the right to change these Terms by notifying the User. If the User continues to use the Service after the stated effective date of the amended Terms, the User is deemed to have accepted the amendment.
